Terms of Use and Sale

These terms apply to the use of the Rust server “Tortuga”, this website and the purchase of virtual perks in our store. The provider of the game services is Volodymyr Solontsov (see Imprint).

Purchases are processed by PayNow Services, Inc. as reseller (merchant of record). The purchase contract for the payment is concluded with PayNow; PayNow issues the invoice and remits VAT. PayNow’s terms also apply: https://paynow.gg/legal/terms-of-use and https://paynow.gg/legal/platform-eula. We provide delivery in game.

• Letter of Marque (7, 30 or 90 days): the perks described on the home page. The duration only starts when you activate it in game under /menu → Cart.
• Minicopter /mini: calling and dismissing your own minicopter until the end of the current wipe, regardless of the purchase date and even if it stayed in the cart until then.

Perks are credited to the in-game cart linked to your SteamID64 once payment is received. They have no cash value, are not transferable and cannot be exchanged for money.

Game progress (buildings, items, blueprints) is reset about once a month (“wipe”). Maintenance, game updates and technical faults may make the server temporarily unavailable; we do not owe uninterrupted availability.

As a consumer in the EU you generally have a 14-day right of withdrawal from the conclusion of the contract. Declare the withdrawal to the seller PayNow (via the support link in your order confirmation) or to us at rust.tortuga@gmail.com; we will forward it.

For digital content the right of withdrawal expires early if performance begins with your express consent and you have acknowledged that you thereby lose your right of withdrawal (§ 356(5) BGB). This consent is obtained at checkout on PayNow’s page.

Send refund requests to PayNow within 14 days of purchase; PayNow decides on refunds together with us. If a purchase was not credited in game, please open a ticket on Discord — we will deliver it or arrange a refund. Your statutory rights remain unaffected.

The rules apply on the server. For violations, in particular cheating, we may ban players temporarily or permanently. During a justified ban, purchased perks cannot be used; to the extent permitted by law, there is no claim to a refund in this case.

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are only liable for breach of an essential contractual obligation, limited to the foreseeable, typical damage. Liability under the Product Liability Act remains unaffected.

German law applies. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence. The German version of these terms prevails.
